What legal rights (if any) does Milesofpaper Ltd have in respect of payment for the stationery and office equipment??

Introduction As Mr Frank and Mr Stamp entered into the contract with Milesofpaper Ltd before the incorporation of Wearboaters Ltd, it would appear that the contract was entered into under the partnership of Pleasure Boats & Co and thereby governed by the Partnership Act (PA) 1890. In order for a partnership to be created, there must be two or more persons that conduct business with a view to profit. Partnerships are defined under s. 1(1) PA 1890 as a â€Å"relation subsisting between persons carrying on business in common with a view of profit†. Mr Frank and Mr Stamp had clearly entered into a partnership as they carried on business (pleasure boat building and repairing) with a view to profit; Khan v Miah, Ahad and Miah[1]. Unlike companies, partnerships do not have a separate corporate personality and are instead regarded as a collection of individuals or persons.[2] This means that each partner is jointly liable, without limit, for the debts and obligations of the partnership incurred wh ile he or she is a partner (s. 9 PA 1890). Mr Frank and Mr Stamp will therefore both be personally liable for any debts the partnership incurred; M Young Legal Associates Ltd v Zahid[3]. In considering whether Milesofpaper has any rights in respect of payment for the stationary and office equipment, it will need to be considered whether Mr Frank and Mr Stamp are personally liable the contact is capable of binding the partnership. Given that both partners entered into the contract with Milesofpaper, they will be deemed to have had actual authority to bind the firm. S. 5 PA 1890 states that every partner is an agent of the firm whose acts bind the firm and his partners, unless the partner acting had no authority to do so. Given that both Mr Frank and Mr Stamp would have the authority to enter into the contract with Milesofpaper, it is clear that their actions would have bound the firm. However, because the contract was entered into under the company’s name; Wearboaters Ltd, it is doubtful that this particular transaction will be binding against the partners. It is noted under s. 6 PA 1890 that an act relating to the business of the firm must be done in the firm name or any other manner to be binding on the firm and all its partners. Since the act relating to the business of the firm was done in the name of the new unincorporated company, it is unlikely that the partnership will be liable for the debt. Ye t, the individual who entered into the contract may be liable for the debt as their own private act[4]; Sangster v Biddulph[5]. Furthermore, even though Wearboaters Ltd has now been incorporated, Milesofpaper Ltd will not be able to enforce the pre-incorporated contract. The reason for this is that; â€Å"before incorporation, the company is not competent to enter into contract in its own name as it has no legal entity†[6]. As such, Wearboaters Ltd will not be capable of being sued for the pre-incorporation contract that was entered into between Mr Frank, Mr Stamp and Milesofpaper. In Re English & Colonial Product Co[7] it was held that a company was not liable to pay for services and expenses incurred by a solicitor pre-incorporation as the company was not in existence at the time when the expenses were incurred. In addition, it was also held in CIT v City Mills Distilleries (P) Ltd[8] that a company has no status prior to its incorporation and can have no income or liability. As the company had not been incorporated, Mr Frank and Mr Stamp will be classed as ‘promoters’ who will have purported to enter into a contract by or on behalf of Wearboaters Ltd[9]. As promoters, Mr Frank and Mr Stamp will be personally liable unless the contract states otherwise (s. 51 Companies Act (CA) 2006). In Phonogram Ltd v Lane[10] it was held that a promoter of a company was personally liable to repay a deb t that was made on the company’s behalf under s. 51 CA 2006 (previously 2. 36 CA 1985) even though the claimant was unaware that the company was not in existence at the time the contract was entered into. Overall, it is likely that Milesofpaper will have a claim against Mr Frank and Mr Stamp in respect of payment for the stationery and office equipment. What legal rights (if any) do Mr Frank and Mr Stamp have in respect to payment for compensation for the destroyed boats and equipment? Once a company has been incorporated, it is separate and distinct from its members as shown in Salomon v Salomon[11]. Here, it was made clear that a company shall be solely liable for any losses or mishaps that arise within the company. In accordance with this principle, a company has the capacity to enter into contracts and sue and be sued in its own name. If the company suffers a breach of contract, it is the company who will be able to sue on the contract for breach and thereby seek to take the appropriate remedial action[12]. As business assets are owned by the company, it is the company who is responsible for insuring them. Because Mr Frank had insured the assets of the business under the partnership, the assets that have been transferred to the company will no longer be insured. This is because Mr Frank does not have an insurable interest in the company’s assets and a new contract would need to have been entered into between the company and the insurer. This was identifi ed in Macaura v Northern Assurance Co Ltd[13] where Macaura was the owner of a timber estate who took out an insurance policy in his own name. Most of the timber was destroyed by fire but Macaura could not claim for loss of goods as he did not have an insurable interest in the timber. It was held that a person cannot claim for loss of goods that are owned by another party. As the company owned the timber, Macaura could not make a claim. Since Wearboaters Ltd is the new owner of the assets, Mr Frank will not be able to make a claim as they no longer have an insurable interest in the assets. When the assets were transferred a new insurance policy should have been taken out in Wearboaters Ltd’s name. As Mr Frank and Mr Stamp have failed to take out a new insurance policy, they will be deemed to have breached their directors’ duties and will be found personally liable for the loss that has been caused to the business. It cannot be said that Mr Frank and Mr Stamp were promoting the success of the company as required under s. 172 CA 2006 and will therefore be liable for any losses incurred; Re Duomatic[14]. This is an exception to the rule in Salomon that a company is separate and distinct from its members and thus allows the corporate veil to be lifted in certain circumstances. In addition, Mr Frank and Mr Stamp also breached their duty to â€Å"exercise reasonable care, skill and diligence† under s. 174 CA 2006 as shown in Secretary of State for Trade and Industry v Goldberg[15]. Although the courts are generally reluctant to lift the corporate veil, they will do so when â€Å"common sense and reality demand it†[16] and when â€Å"there is a powerful argument of principle for lifting the corporate veil where the facts require it†[17]. It could be said that this is to apply in the instant situation as Mr Frank and Mr Stamp should have insured the assets of the business as they were the first directors of Wearboaters Ltd. The courts will only pierce the corporate veil in very limited circumstances, however, and if Mr Frank and Mr Stamp can demonstrate that there was no evidence of â€Å"fraud, illegality or a sham or if the company is a mere facade concealing the true facts† (ss. 213-215 of the Insolvency Act 1986, s. 993 CA 2006 and s. 15 of the Company Directors Disqualification Act 1986), then it is unlikely that they will be found personally liable; Adams v Cape Industries plc[18]. As noted by Talbot; â€Å"veil piecing is not an end in itself but a means to an end†[19]. Therefore, unless the circumstances of the case give rise to fraud or a pre-existing obligation, the courts will be unlikely to pierce the veil in its entirety; Pirelli Cable Holding NV v IRC[20]. It has been said that the courts will â€Å"go to great lengths to avoid any obvious penetration of the corporate veil, whilst still making the sort of inquiries that would be satisfied by just such a process†[21]. T his prevents the doctrine from being completely undermined, whilst also protecting the public; Millam v Print Factory (London) 1991 Ltd[22]. The veil will only be lifted in exceptional circumstances[23] so as to prevent individuals from being discouraged from investing in companies[24]. Overall, given that it Mr Frank and Mr Stamp appear to have made a genuine mistake in respect of the insurance, it is unlikely that they will be found personally liable. Almost every medical advancement has involved using of animals including discovery of penicillin, organ transplantation, vaccines etc. Scientists should use animals in disease research because nowadays it is the only right way to develop drugs, treatments and cures for diseases and to be sure that new products are safe to use.The first reason why animals should be used in lab testing is that it is the best way to do the research not on human beings but on something that is very similar to humans by chemistry, cell structure and organization. Animals quickly reproduce itself and they have short life cycle that help scientists to study effects of the drugs on several generations. Also animals can be donors of organs for humans.The society knows many facts in a last few years about transplanting of animal`s organs into human body. The opponents of using animals in disease research might say that scientists could discover drugs using alternative methods such as computer models. However, scientists should see the drug action in all system of living organism to be sure how it works. Using animals in lab testing and researches is necessary because alternative methods are currently not as reliable. The Jewish Diaspora and Israel Essay The Merriam-Webster online dictionary defines Diaspora as a â€Å"movement, migration of a people away from an established or ancestral homeland† . The term originally applied to Jewish people, who since biblical times have had been expelled from their ‘Promised Land’, the area that encompasses most of present day state of Israel. After independence in 1948, Israeli authorities declared a policy of homecoming for all Jews in ‘exile’. However, many in the Jewish Diasporas chose stay back in their host countries. This essay examines the complexities of interaction between the Jewish Diaspora and its Homeland through the works of Fullilove, Cohen, Sheffer and Shapira. Out of the 13. 8 million Jews, 7. 8 million stay in Diasporas . These are scattered across the U. S, France, Canada, Russia, UK, Australia, Germany, Brazil, Ukraine and South Africa. Most Jews in North Africa and Muslim countries have disappeared. The upward mobility of the Diaspora across the globe has played an important role in their interaction with the state of Israel. While the sentiments of the elder members of the Jewish Diaspora remain strong, the younger Jews under the age of 35 are distancing themselves from their Jewish homeland . They have a more unbiased view of Jewish affairs and in the recent Israeli-Palestine conflict, voiced dissenting opinions on the conduct of the Jewish state and its treatment of the Palestinian Arabs. Organizations such as the Independent Jewish Voices in the UK are one such organization that provides a contrarian view. Israeli Diaspora, according to Cohen comprises of those Jews who migrated out of Israel to other parts of the world. Jewish Diaspora refers to the Jews who were already settled in ‘exile’ from ancient times . The Jewish Diaspora having lived in their host countries for centuries have developed a more inclusive ethos than the newly migrating Jews ex-Israel. The Israeli Diaspora tends to be more conservative and the Diasporic Jews have often labeled the Israeli Diaspora as â€Å"loud, blunt and rude† . The main reason for the Jews to leave Israel has been to find better economic opportunities abroad . The constant stress and compulsory military service were other reasons cited by Jews to leave Israel . Yet others opted to emigrate to pursue higher education. Middle East or African origin Jews chose to leave Israel because of racial discrimination by the white Jewry. The Diaspora has a high rate of self-employment and does very well in financial and business sectors . Jews in Canada have very little affiliation to Jewish orthodoxy and tend to carry a negative image towards organized religion . Jews that migrate from Israel tend to carry their cultural heritage rather than religious identities. As a result, the Israeli Diaspora has a different cultural-religious orientation than the Jewish Diaspora, which becomes yet another point of discordance between the two communities. Second and third generation progeny of the Israeli Diaspora are losing their ‘Israeliness’ that is being replaced with ‘Jewishness’ . Sheffer argues that the relations of the state of Israel with their Diaspora are a unique phenomenon in its breadth and scope of interaction as compared to other ethno-national Diasporas. A large number of Jews no longer consider themselves to be exiles in their host nations . So, now there is no longer an urgency to return to their homeland. Part of this change of heart has been the growing realization that the Israeli state has understood the importance of the existence of the Diaspora in other countries and has made special efforts to engage with them at the governmental level. Thus two major Zionist ideas; return to Israel and negation of exile are no longer being propagated by the Israeli political establishment . The growing acceptance of their national status in their host nations is also a fallout of the weakening of communal ideologies in host nations which now allows the Jews a more inclusive social assimilation . Globalization and liberalization are now making it possible for the Jewish Diaspora to migrate to other host nations instead of the traditional aliyah or homecoming to Israel. In the present day, the transformation in relationship between the Israeli state and its Diaspora would require a redefinition of what constitutes Jewish identity and how to manage the State-Diasporic relationship . According to Shapira, while the Jewish Diaspora has fared well in the developed world, their brethren in the developing world have had no such socio-economic success. Coming from the lower socio-economic strata also limited the influence and adaptability of these Jews in their adopted homelands, which also affected their assimilation on return to their homeland. â€Å"Every wave of emigration produced a perceived dilution of the native Israeli identity that led to tension between the locals and the emigrants forcing a halt to immigration from time to time to allow for assimilation. On the opposite end of the spectrum are Jews who are leaving Israel for a variety of reasons. Some find the conflict in the Middle East and the daily threat to their lives too stressful. Others leave Israel for personal ideological reasons. This lot believes that the Israeli state puts too much premium on the Jewish religion as the core national value and wish to migrate to more inclusive locales. The out-group Jews have lesser attachment for Jewish causes in their adopted lands but nonetheless, the government of Israel realizes their importance in shaping international perceptions and keeps them engaged through their Ministry for Diaspora Affairs as well as Track II organizations. In the developed world, the Diaspora has achieved positions of affluence and influence. In the developing world they have remained at the lower end of the socio-economic strata, which has been the main driver for these communities to exercise their right to return to their Jewish homeland. The younger generation of Diaspora below the age of 35 has a lesser attachment to their homeland. Some have even raised contrarian views to question the conduct of the Israeli state in resolving the Palestinian issue. Others have opted to migrate out from Israel for a number of reasons such as better economic options, religious reasons or to escape from physical insecurity. Whatever be the varied contours of interaction of the Diaspora with the State of Israel, there is no denying the fact that the Jewish Diaspora is the most powerful and well organized community on which the homeland has great dependence. Pedagogical Principles of Teaching Developing Teaching, Learning and Assessment in Education and Training 1.1 Analyse the application of pedagogical principles in own area of specialism. Pedagogical Model: Understanding by Design (UbD) is an academic framework for designing curriculum units, performance assessments and instruction that evolve a deeper and better understanding amongst the learners. It facilitates the process of learning by setting achievable goals and objectives. Designed by Grant Wiggins and Jay Mc Tighe, the model scrutinises the traditional methods and suggests more coherent, versatile and conductive ways related to planning, teaching and assessing. The essence of the model lies in to begin with the end in mind. It simply implies to keep the destination in mind before taking the first leap thereby taking steps in the right direction. The process of learning in human beings is constantly under research and tight scrutiny. Over a period of time, many researchers of this field have concluded that human ability to learn is greatly affected by the interaction of ideas. The exchange of meaningful learning experiences in progressive and conducive environments assists in discovering and exploiting our potentials to their optimum levels. The learning experiences are very often used by the teachers to motivate the quest of learning amongst the students. The sharing of poor ideas helps us to interact and foment a climate of understanding thereby developing new learning scenarios. This meaningful interaction puts great influence on the process of learning as a whole. We also learn to interpret new experiences and modify our own conceptions through the dialogue. In order to make best utilization of this concept, we need to create meaningful activity and relate it to our perceptions of life. In light of this research, new processes and learning methodologies are being evolved to help learners and teachers in making its best utilization. Grant Wiggins and Jay Mc Tighe are the pioneers in implementing the concept on ground by designing a new methodology of learning called the Backward Design. The use of Backward Design model as part of the concept of Understanding by Design has proved to be an extremely effective tool in addressing the learning needs of human beings (Hammond, 2005). The Backward Design model provides a new approach to teachers and learners by focusing on keeping the goals and objectives in mind. This design puts less emphasis on the specific activities of and rather involves paying attention to the strategic intents and outcomes of their curriculum. The model starts with defining what students want to achieve or know and then framing curriculum which guides to the desired objective. Although the Backward Design does not totally oppose the traditional methods, however it objects to the routine collection of facts that one often tends to forget after the test (Pankratz Petrosko, 2000). Unless it has been decided as what the students should understand (objectives), plans cannot be made to substantiate the effort required to be put in to achieve those goals. Once the curriculum designer knows what students should understand, consideration moves to how to capture and document this understanding. The enduring understanding is the hallmark of the Backward Design. All the planning perimeters and curriculum designing are of little use until the principles of backward design are kept in mind. The sole purpose is to progressively achieve those levels of understanding which human mind has never experienced before. The efficacy of this model can be best visualised from the fact that at Harvard Graduate School of Education, the most efficient model of learning being prescribed and pursued is the Teaching for Understanding which in many ways goes in line with the concept of Understanding by Design (Wiske, 2005). 1.2 Evaluate the effectiveness of use of creative and innovative approaches in own area of specialism. Principles of Teaching and Learning in Teaching Maths: Students learn maths through the experiences that teachers provide. Teachers must know and understand deeply the maths they are teaching and understand and be committed to their students as learners of maths and as human beings. There is no one right way to teach. Nevertheless, much is known about effective maths teaching. Selecting and using suitable curricula materials, using appropriate instructional tools and techniques to support learning and pursuing a continuous self-improvement are actions good teachers take every day. The teacher is responsible for creating an intellectual environment in the classroom where serious engagement in mathematical thinking is the norm. Effective teaching requires deciding what aspects of a task to highlight, how to organise and orchestrate the work of students, what questions to ask the students having varied level of expertise and how to support students without taking over the process of thinking for them. Effective thinking requires continuing effort to learn and improve. Teachers need to increase their knowledge about maths and pedagogy, learn from their students and colleagues, and engage in professional development and self-reflection. Collaborating with others paring an experienced teacher with a new teacher or forming a community of teachers to observe, analyse and discuss teaching and students thinking is a powerful, yet neglected form of professional development. Teachers need ample opportunities to engage in this kind of continual learning. The working lives of teachers must be structured to allow and support different models of professional development that benefit them and their students. Features of effective learning and teaching in maths: From the early stages onwards, children and young people should experience success in maths and develop the confidence to take risks, asks questions and explore alternative solutions without fear of being wrong. They will enjoy exploring and applying mathematical concepts to understand and solve problems, explaining their thinking and presenting their solutions to others in a variety of ways. At all stages, an emphasis on collaborative learning will encourage children to reason logically and creatively through discussion of mathematical ideas and concepts. The experiences and outcomes encourage learning and teaching approaches that challenge and stimulate children and young people and promote their enjoyment of maths. To achieve this, teachers will use a skilful mix of approaches, including: planned active learning which provides opportunities to observe, explore, investigate, experiment, play, discuss and reflect modelling and scaffolding the development of mathematical thinking skills; learning collaboratively and independently; opportunities for discussion; communication and explanation of thinking; developing mental agility; using relevant contexts and experiences familiar to young people; making links across the curriculum to show how mathematical concepts are applied in a wide range of contexts, such as those provided by sciences and social sciences using technology in appropriate and effective ways; building on the principles of assessment for learning; ensuring that young people understand young people understand the purpose an d relevance of what they are learning; developing problem-solving capabilities and critical thinking skills. Teachers need to understand and be committed to their students as learners of maths and as human beings and be skilful in choosing from and using a variety of pedagogical and assessment strategies (National Commission on Teaching and Americas Future1996). In addition, effective teaching requires reflection and continual efforts to seek improvement. Teachers need to understand the big ideas of maths and be able to represent maths as a coherent and connected enterprise (Schifter 1999; Ma 1999). Teachers also need to understand different representations of an idea, the relative strengths and weaknesses of each, and how they are related to one another (Wilson, Shulman and Richert 1987) As a maths teacher, I apply the following teaching approaches: Individual Work: I still believe that individual work has the most significant and effective influence on students. Individual work facilitates one on one interaction among students and teachers. I still believe that individual work has the most significant and effective influence on students. Some limitations include: While individual work will enable the students to improve their performance level, and teachers to individually assess the students. However it does not facilitate any team work or collaboration between the students, and the students would feel isolated. It would also restrict the students from learning and obtaining effective experiences and knowledge from other students. Group Work: I believe that group work is essential to develop team work and facilitate collaboration between students. As a religious studies teacher I believe that it is essential to promote social harmony and facilitate collaborative work between culturally diverse individuals and groups of individuals. Group work facilitates effective participation and communication, and also builds up leadership skills among students. It is perceived by many experts that group work provides a basis for effective team work, leadership, communication and collaboration (Wurdinger Carlson, 2009). Limitations include: Even though group work is an effective learning tool, the resources required for group work is high. Group work requires a significant amount of time, materials and space. If the teacher is not able to provide these resources to students, the group work will not be effective. Furthermore group work can also have many disputes which would hinder the main objective of undertaking group wo rk. Also there is the limitation of all students not participating equally for group work. Presentations: Presentations are considered to be the most effective tool of visual learning. Presentations are utilized by teachers to increase the interest and concentration level of students. Earlier students were provided with study notes and the teacher followed the provided material. There was a clear limitation in this method, as the students lost concentration and interest in this method. Especially I have experienced that utilizing presentations for a subject such as religious studies, helps to attract the students and maintain their interest. Experts believe that presentations are more effective and accurate than utilizing printed material. I agree with this statement and believe in utilizing effective presentation during my teaching sessions (Wilson, 2009). Limitations include: Presentation require a high level of software and hardware equipment. Personally I have experienced difficulties due to the limitations of resources, and I have been unable to effectively present th e study material effectively. Both teachers and students have faced hardships due to these limitations and few study sessions have been wasted due to these restrictions. Online Learning and Group Discussions: I promote online learning among my students as I believe that online learning provides a great way for the students to obtain timely and relevant information related to the subject matter. It would also enable the students to obtain information regarding the most recent developments. Online discussion also helps students to interact and share their knowledge with others and also obtain support from the teacher outside classroom hours. I agree with the experts that online learning has a plethora of advantages, which facilitate a more effective knowledge sharing and learning culture among the students (Bender, 2003). Limitations include: the lack of resources. There are many students who do not have access to web sources and have no proper ICT knowledge. Also depending too much on online resources would sometimes be inaccurate and also deviate students from their primary objective. Tutorials: In addition to my lessons, I always ensure to hold a considerable number of tutorial sessions for my students. With experience I have realized that tutorials help the students to obtain a better understanding about the subject matter and apply the theoretical knowledge obtained during the study sessions. Limitation include: I have observed that at times tutorials tend to make students follow the lesson mechanically, instead of obtaining an in-depth understanding about the subject matter. Housebreaking Puppies :: essays research papers

Puppies are warm and fuzzy creatures that need to be trained properly to use the bathroom in certain places. The problem is many people purchase puppies without educating their family on how to properly train them. The solution to this problem is to paper train your puppy. The owners need to understand that accidents do happen, and owners need to be patient and understanding about these accidents. Problems arise with housebreaking puppies. The problem is that puppies have little bladder control and want to relieve themselves at any given time. This is where the problem begins. Puppies will soil carpets, which goes through to the pad; and if not cleaned properly, the smell of the urine will be overbearing to the owner. Soiling of the owners carpet may cause them to replace the carpet which can be a big expense to the owner. The carpet needs to be cleaned thoroughly with an odor eliminating disinfectant. Ammonia products are not recommended since these may remind the puppy of its own urine smell. Regular household cleaners will mask the smell from humans, but not from the puppy. The cleaners usually attract the dog back to the same place. A veterinarian will usually recommend white vinegar and water rubbed over the area to help remove any stain or smell from the carpets  Ã‚  Ã‚  Ã‚  Ã‚  Paper training puppies can be a rewarding experience for both the owner and the puppy. The owner needs to pick a spot for the newspaper where he or she wants the puppy to relieve himself. The puppy needs to be placed on the paper after eating, playing, drinking, and waking up (Fogle, 1993, p. 36). Every few hours the puppy needs to be placed on the paper and say to them â€Å"go potty.† Eventually the puppy will understand after praise is given what â€Å"go potty† means. As much as puppies tend to eat and drink, and if the owner places them on the newspapers often enough, sooner or later the puppy will catch onto what is expected of them.   Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  The owner needs to be consistent with this process to reinforce the behavior that is desired. THEME ON EMILY DICKINSON :: essays research papers

Poems of Emily Dickinson Thesis of my paper that I am trying to prove to the reader is that Emily Dickinson is a brilliant extraordinary writer. She talks about mortality and death within her life and on paper in her poem works. Although she lived a seemingly secluded life, Emily Dickinson's many encounters with death influenced many of her poems and letters. Perhaps one of the most ground breaking and inventive poets in American history, Dickinson has become as well known for her bizarre and eccentric life as for her incredible poems and letters. Numbering over 1,700, her poems highlight the many moments in a 19th century New England woman's life, including the deaths of some of her most beloved friends and family, most of which occurred in a short period of time (Introduction, Paragraph 2). In many short poems, several readers or critics of Dickinson point out her methods of exploring several topics in "circumference," as she says in her own words. Death is perhaps one of the best examples of this exploration and examination. Other than one trip to Washington and Philadelphia, several excursions to Boston to see a doctor and a few short years in school, Dickinson never left her hometown of Amherst, Massachusetts. In the latter part of her life she rarely left her large brick house, and communicated even to her beloved sister through a door often left "slightly ajar." This seclusion gave her a reputation for eccentricity to the local towns' people, and perhaps increased her interest in death (The Belle Of Amherst, Dickinson). Some knew Dickinson in Amherst as, "the New England mystic,". Her only contact to her few friends and correspondents was through a series of letters, seen as some authors and critics to be equal not only in number to her poetic works, but in literary genius as well (Introduction Dickinson). Explored thoroughly in her works, death seems to be a dominating theme through out Dickinson's life. Dickinson, although secluded and isolated, had a few encounters with love; two perhaps serious affairs were documented in her letters and poems. But, since Dickinson's life was so private the exact identity of these people remains unsure. What is known, is during the Civil War, worried for her friends and families' lives, death increased in frequency to be a dominant theme in her writings. After 1878, the year of her influential father's death, (a treasurer of Amherst College, and a member of the Congress), this theme increased with each passing of friend or family, peaking perhaps with the death of the two men she loved (The Belle of Amherst, Dickinson).

Death penalty Essay

Introduction Over several years, the death penalty has existed among various countries, and used to eliminate killers who are considered extremely dangerous in the society. According to various sources, the fear associated with the death penalty discourages individuals with the propensity of conducting such inhumane crimes. Application of the death penalty, however, comes with mixed reactions from the society since some people support it while others are against it due to various reasons. Therefore, this essay seeks to justify the rightfulness of the death penalty since it is associated with a significant level of reduction in malicious murders. Arguments against Death Penalty In a number of cases, the death penalty has resulted in various disputes; for example, where innocent individuals have been convicted despite the fact that they were not involved in such crimes. Unfortunately, some of these victims were executed, or put on the death row just before the truth was established, and their innocence proven (Harris, 2012). From 1973, 11 Texans and 128 others across the United States have been set free and cleared from the death penalty as a result of proof of their wrongful conviction (All Voices, 2012). Generally, the death penalty is considered as the harshest sentence for any known felony. More so, it is the only punishment that will remain irreversible after the sentence has been made. When an inmate is found not guilty of committing the crime that led to his imprisonment, they can always be set free and have their names cleared. However, where the convict had already been put to death, the punishment can never be reversed: In no circumstance will saying – sorry, we had the wrong person – help the family of the victim, but will only increase their pain. Several people are usually against the idea of the death penalty due to the possibility of executing innocent people. Such people would never want to imagine the risk of executing innocent people; in fact – for nearly ten years now – innocence has resulted in the creation of a strong argument in death penalty dialogue. In this fight, abolitionists have played an important role especially where they have successfully pointed out the innocence in some convicts with the aid of post conviction DNA tests (Aronson & Simon, 2009). Arguments in Favor of Death Penalty On the other hand, the death penalty is considered as an eye for an eye and that all convicted killers should be executed in order to attain evenness. The most horrible felony warrants no less than the most horrible sentence, which should mean an eye for an eye. As such, the victim’s family should feel that the offender was given the most intense judgment other than just being locked up in a prison and keep enjoying their life. In many unfortunate cases, the murderers have been given a life sentence without a possibility of parole, and they have managed to live for longer periods than their actual victims actually lived on earth. To make the situation worse, such inmates live a comfortable life in prison, getting three meals per day and an afternoon to practice, while the victim’s family lives a life of anguish. Denis Rader (BTK), born and raised in Wichita, Kansas, was an excellent example of a very notorious serial killer that used to bind, torture and kill his victims without any mercy (Harris, 2012). In one of his dreadful attacks, he killed an 11-year old girl called Josephine Otero by hanging her from a drain pipe (Harris, 2012). Unfortunately, the murderer was given a 175 years sentence despite the fact that he killed an entire family, as well as other innocent people (Harris, 2012). Actually, it is not justified for a murderer to live while innocent people suffer death: Rader did not have the right to torture and kill his victims, so it is not justified that he was granted a right to his life. In several cases, some of the most dangerous killers have only spent their life in prison. As such, is there anything, or a particular sentence that could assist in reducing the intensity of murders within the society? Several studies have indicated that the fear of death discourages people from committing various targeted crimes. Capital punishment would serve as an excellent solution since it would assist in lowering murder crimes; hence, it would serve as a perfect crime preventive solution. As such, most criminals would think twice before killing their victims since they would realize the fact that their lives were at stake for any murder act. I would say that the use of the death penalty could certainly lower the incidences of violent murders since this would play a crucial part in the elimination of cruel repeat offenders. In connection, statistics show that there are approximately 20,000 murders every single year within the United States, which drastically increased from 10,000 deaths per year after the death penalty was dropped in some states (Boys, 2012). The elimination of the death penalty, 1965; therefore, led to increase in the number of murders by about 10,000 people per year (Boys, 2012). With these statistics, it is evident that murderers commit more murders due to the knowledge that the worst they could get for murder is life imprisonment. This means that bringing back the death penalty would help in the reduction of brutal murders by repeat offenders. However, the death penalty should be implemented where the evidence for murder can be proved beyond any reasonable doubt so as to avoid executing innocent victims. Conclusion It is evident that the arguments in favor of implementing the death penalty far much outweigh those against its implementation. I would then mention the fact that the death penalty will assist in lowering cases of malicious murders within the society, as well as serve as the best sentence when compared the affliction of the victim’s family. Hence, I conclude this essay by supporting the fact that implementation of the death penalty is justified because it assists in the reduction of malicious murders; at the same time, remains the best punishment for convicted murderers.

Hamlet, a play by William Shakespeare, is the tragic story of a young prince’s journey of self-discovery as he struggles to overcome the tragic occurrences in his life: his father murdered by his uncle, and his mother who incestuously marries the killer. Hamlet is plagued with the responsibility of avenging his father’s death, and setting right the kingdom of Denmark, all while suffering from a severe melancholia. Hamlet acts crazy in an effort to fool people into letting their guards down, allowing him to seek out revenge. Hamlet is depressed, mourning the loss of his father and his mother’s betrayal. While Hamlet’s depression causes him to act out of character, acting on impulse, his madness is just a pretense to cover his true motives. Hamlet’s madness only manifests itself when he is in the presence of certain characters; his ability to use logic and reasoning reinforces his sanity. In mourning, Hamlet dresses in all black, refusing to celebrate his mothers wedding, and his uncle’s coronation. The recent events have caused Hamlet to lapse into a depression; grief has overwhelmed his spirit, he feels alone and betrayed by his mother. He cannot come to terms with his mother’s actions; he does not understand how she could so quickly forget his father and marry his uncle. So in conclusion Shakespeare’s play Hamlet and it’s main protagonist’s sanity are still subject to question. And I suppose we will never know the truth of the well being of Hamlet’s mind.

South Africa is one of the African countries, which is rich in history and culture. Different racial and cultural groups ranging from Afrikaners to the Indians are staying together in South Africa. This paper analyzes the prejudices and discrimination against South Africa: the Coloured’s and the Black AfricansIntroduction†At least 77% of South Africans are Black Africans.†South Africa has a very diverse and rich cultural nature and therefore has no National Culture. Till then the black South African people were victims of discrimination and prejudices even thought they were the largest c ommunity in South Africa. Coloured’s and the Black AfricansColoured’s are a mix of Black Africans and (British) Whites. They are so named because of the apartheid regime, as a way a labeling them; however, since then they have developed their own distinct culture. They reside mostly in the Northern and Western Cape. About 80% speak Afrikaans and 20% speak English. The South African society were divided four main racial groups during the apartheid era; Blacks, Whites, Coloured’s and Indians. Based on the color of the people the political rights were also varied among these groups. The whites enjoyed supremacy in every field of life like political cultural and religious things. Even the people from the same religion experienced discrimination because of their skin color. Earlier the political rights of the coloreds were similar to that of the whites though their rights to earn income and property were limited by the law. Prejudices and DiscriminationPrejudice is the positive or negative evaluation of a social group and its members. It differs from stereotyping in that the emphasis with prejudice focuses more on emotional than cognitive factors.  Prejudice is largely an attitude. In South Africa, the minority white people controlled the entire process of ruling of the country. They were stripped of their right to call themselves Africans and were labeled colored. They were robbed of their land, culture, language, and identity. But as the time passes, they realized that nothing has changed for them. The white people were still kept a distance from them and they were failed to enjoy the human rights which the white people enjoys. Although they have progressed much as a people, they still have a long way to go. Many black Africans live way below the poverty line and many Afrikaners live above it, creating a division among them. Most of the wealth is accumulated among the white people. The black people are still weak economically, politically and culturally. It is easy for the white people to dominate in every aspects of human life in South Africa even now because of the above factors. In South Africa the infection and deaths from HIV/AIDS exceeds that in most  other countries. More over the HIV/AIDS problems found mostly among the black community which opened another door for discrimination. The white people were eagerly waiting for a genuine reason to keep the black people at a distance since in the present century; it is a shame for a civilized society to follow the racial discrimination. The HIV/AIDS problem provided them another opportunity to sustain the discrimination which was supposed to be ended once. Government inaction and certain dangerously mistaken beliefs and abusive practices concerning the protection from the disease are largely responsible for this line of discrimination. The illusions about the spreading of AIDS are deliberately spreaded by the white population to keep the black people away from them. ApartheidApartheid is a social policy or racial segregation involving political and economic and legal discrimination against people who are not Whites. (Definitions of apartheid on the Web) Apartheid separated all Europeans and other races living in South Africa. The African community has divided over the color of their skin during this period. â€Å"The system of racial segregation first promulgated by the largely Afrikaner National Party of South Africa in 1948. On a much larger scale was the allocation of 12% of the land area into ‘independent republics’, or ‘homelands’, for the African population, which comprised 69% of the population when the policy began, in 1954.† (Apartheid) The main aim of this apartheid policy was to tie up the Africans to their ‘homelands’ alone which will be governed and developed separately by the white’s government. The black people were allowed to enter the white premises only when the black labor was required. Public places or facilities such as lavatories, transport, parks, and theatres were divided into two groups: white and non-white. In 1990 South Africa’s last non-indigenous president lifted the ban on the ANC and released all political prisoners including Nelson Mandela. The Homelands system was abolished with the end of Apartheid and independent elections were held with equal voting right to all irrespective of the color which resulted in the making of Mandela as the first president of South Africa after the apartheid ended. ConclusionSouth Africa can be considered as the latest country which escaped  from the social evil of different class system based on the color (apartheid). The South African society consists of people from different parts of the world. But all of them treated differently by white led government. Mr. Tang and Mr. Li are the participants of an interesting incident in the Beijing’s division of Intel China that can be analyzed with the help of some important Chinese concepts like face, hierarchy and preservation of social harmony. Mr. Tang is the new manager of the marketing programs of Intel China in Beijing, and has a background of Western education and years of working experience in the United States. Mr. Li is a young but skilful account manager, enthusiastic and assertive, who has been carrying on the project of creating a manual of tips for software vendors for two months and plans to carry it on till its completion. After taking over Beijing’s Intel division Mr. Tang decides to study the work of each employee and to make changes where necessary. One of his adjustments involves Mr. Li’s project. Since Mr. Tang considers this task extremely time-consuming and unsuited for an inexperienced employee, he decides to discontinue his project and assign him to a more appropriated one. He asks Qing Chen (Mr. Li’s supervisor) to inform him of his resolution, but Mr. Li opposes firmly to this change, asserting that his superior is not being respectful. Analyzing the situation we can see that there are several Chinese communication patterns which play an important role and influence these people behaviour. Mr. Tang uses an intermediary (Miss Chen) to communicate the problem to his employee, and this is a common strategy in China. He avoids direct confrontation with Mr. Li, and this is an act that aims to safe face for both of them. However with his response, Mr. Li is causing Mr. Tang to lose face, he is endangering his authority and his ability to control and guide his employees. It’s clear that Mr. Tang is acting in the best interest of his company, and his power shouldn’t be questioned. In fact, in Chinese business context is very unusual to see an employee reacting like Mr. Li, questioning a boss’ decision and showing dissent. But, even so, Mr. Tang shouldn’t fire him, given Mr. Li’s important role in the company and the number of guanxi he has established with other firms’ managers. Regarding Miss Chen, her lack of authority and of immediate response to Mr. Li’s critics is probably caused by her inexperience in managerial positions. In their next meeting Mr. Tang should try to make him understand the reason of his decision, without forgetting to start by praising his work and his efforts. Chinese people are very concerned about reputation and the need to be respected by others, so to avoid both Mr. Tang and Mr. Li to feel embarrassed and lose face, the best solution is for Mr. Li to accept Mr. Tang’s decision. This act, that implies giving face, will be very appreciated by Mr. Tang, who in the future will not forget to reward his employee. In China preserving the social harmony plays an important role when doing business, and Mr. Li should try to shape his working attitude according to this concept, that is also part of the Intel philosophy. In conclusion, I find myself completely in accordance with Mr. Tang managerial style, he acted like a pure Chinese, not as an expatriate. Actually, given Mr. Li’s excessive response, it looks like he is the one who has been influenced by Western ideas.

What is Strategic Human Resource Management Essay Strategic Human Resource Management (SHRM) is concerned with establishing a specific and managed cause and effect relationship between an organisations actions to survive and grow and its HRM principle and practices. It is also concerned with the mechanism through which people in an organisation gain an understanding of the purpose of the organisation, its goals and strategic objectives. As well as how the organisation related to its external environment in order to achieve these goals and objectives (SHU International MBA, Intro to SHRM unit p. 1) Introduction Human resource management (HRM) can broadly be defined as a strategic and coherent approach to the management of an organizations most value asset the people work there, who individually and collectively contribute to the achievement of its objectives for sustainable competitive advantage. As described by beer et al (1984): Human resource management involves all management decisions and action that affect the relationship between the organization and employees It human resource.1 The different between Strategic Human Resource management (SHRM) and Human Resource Management (HRM) can be seen as the word of Strategy, Strategy, as it has come to be applied in business, is a market-oriented concept it is fundamentally concerned with products and competitive advantage. The different between are integrated as follow: Strategic human resource management is concerned with those decisions which have a major and long -term effect on the employment and development of people in the organisation, and on the relationship which exist between its management and staff. An HR strategy will express the intention of the enterprise about how it should manage its human resources. These intentions provide the basis for plans, development and programmes for managing chance. The aim of SHRM is to ensure that the culture, style and structure of the organization, and the quality, commitment and motivation of its employees, contribute fully to the achievement of Business objective. Main features of strategic human resourse management It has been suggested by Hendry and Pettigrew (1986) that the main features of strategic human resource management are as follows: The use of planning A coherent approach to the design and management of personnel systems based on an employment policy and manpower strategy, often underpinned by a philosophy HRM activates and policies are matched to some explicit business strategy The people of the organisation are seen as a strategy resource for achieving competitive advantage Formation of Strategy To understand how the SHRM can effect the whole organisation, we need to go thought the Organisation Structure and see the how Strategy Management works. The strategic management process is typically broken down into five step: 1. mission and goals 2. environmental analysis 3. strategic formulation 4. strategy implementation 5. strategy evaluation We are not interested for Step 1 and Step 2, because at these two stages, the Strategy is not form yet. It was still in the planning process, after the Strategy had been developed, it will transfer to Step 3- Strategic Formulation. Strategic Formulation involves senior manager evaluating the interaction between strategic factors and making strategic choices that guide managers to meet their organisation goals. Some Strategies are formulated at the corporate, business and specific functional levels. Hierarchy of Strategy Another aspect of strategic management in the multidivisional business organization concerns the level to which strategic issues apply. Conventional wisdom identifies different levels of strategy a hierarchy of strategy 1.corporate 2.business 3.functional Its because we are not interested in Corporate-Level strategy Business-level strategy. The deeper explanations will be place in the appendix. Functional-level strategy Functional-level strategy pertains to the major functional operations within the business unit, including research and development, marketing, manufacturing, finance and HR. This strategy level is typically primarily concerned with maximizing resource productivity and addresses the question,  How do we support the business-level competitive strategy? Consistent with this, at the functional level, HRM policies and practices support the business strategy goals. Developing human resource strategies Human resource strategy contributes top the business strategy but is also justified by, the aim should be make it imaginative, innovative, clear and actionable. Its must also be selective, focusing on priorities, and flexible, rapidly adjusting to change. HR strategy should be formulated by s continuous process of analysing what is happening to the business and where it is going. So, we do know why we need SHRM to support organisation strategy, but how can we implement the SHRM to the organisation, and what kind of tools and practice we can use to shaping the organisation strategy in the term of Human Resource Management. The answer for this is fairly easy, we know the Top Level is the Strategy, and the bottom level is the worker on work floor. The linkage between these is a linkage mechanism, which general identify as Manager of that particular department. What is the responsibility of manager? In general, the key of a manager is to keep a good relationship with the employee, without the good relationship, the organisation will unable to run the daily task to achieve what they got to achieve. In other word a manager is trying making out the most from the employee to optimise the company performance. And the follow is what a manager should do for their duties: Ability to Motivate worker recruitment and staffing employee development employee relations Leadership Communication and culture Teamwork Ability to motivate worker Motivation is defined as the willingness to do something conditioned upon the actions ability to satisfy some need for the individual. (Robbins De Cenzo, 2001) Motivation is the key to getting the job done because without it, projects and jobs are completed with no purpose or direction. Moreover rewards and bonuses gained by employees increase their moral as well as benefiting the organization. Appraisal systems for some time have served to prove that the performance of employees is under control or to give the appearance of control Recruitment and Staffing Recruitment and Selection is a well-worn topic, which is treated fully in all major texts. Just remember that there is always a tension between getting the right person for a job and how much resource in terms of time and money is devoted to recruitment. The more accurate the recruitment, the more benefits the organization will achieve. This is because the employee will carry out their tasks more appropriately and will be ideal for the new post and will be able to take responsibilities. The more recruitment in an organization, the higher the overheads and therefore HRM needs to be effectively managing and deciding whether there is a need of recruitment or not. Training and development Training and Development are currently big issues for many businesses in most  parts of the country, especially where there are low rates of unemployment. Moreover, Increase in training and development has increased productivity as well as employees moral. This is beneficial for both, the company and the employees. Although the costs of HRM increase in the short term as training and development is very expensive but at the long term it is very beneficial for an organization as job commitment is reinforced and quality increases to Employee relations Develop and maintain effective employee relations activities and programs which you can use to help create a positive organizational culture. Handle difficult employees with confidence, and learn how to reinforce good behavior as well as discipline, and terminate properly if the need arises. In addition, you will look at ways to get your employees involved and assess their needs and opinions. Leadership The leadership is someone who exercises influence over people. The ability to influence also needs the permission of those to be influenced. The functions of Lead in organization may include Enabling people and group to achieve their objectives Setting and communication objectives. Monitoring performance and giving feedback Administering rewards and punishments Clarifying and solving problems Making decision on behalf of others Represent the group to others Providing information, advice and expertise Communication and culture Communication is very important to a manager, the purpose of the manage is get people connected together, from the top-side of the CEO to the bottom side of the Shop-floor worker, without the communication skill the manager may send the wrong message the audience. Teamwork Teamwork emphasizes the successful of business. As we know there are a lot of task cannot carried out by one people such as decision making, planning and problem solving. Teamwork can speed-up the task to achieve the goal in a efficient way. Factors to implementing change to the organisation After we understand the role of the management, but how cans a manager to implement the strategy to his department, the Keyword is CHANGE. The question is how can a manger to change the behaviour of the worker to ways that will match the organisation goals and strategy. Before the implementation of change, we should make sure the manager had got the capacity to handle the change. And there are three questions to ask the manager. Does he have the right attitude? Does he have the appropriate knowledge? Do we have the necessary skill? Right Attitude for the manager A change agent cannot succeed without great persistence. Change is a complex and laborious process that arouses strong feelings and emotions. Angry people, frustrated teammates, conflicting priorities, unforeseen problems or behind-the-scene resistance pose daily challenges. A project manager cannot lead her team through these minefields without determination and stamina. To avoid mid-course changes in leadership, the person must be fully committed to see the project through completion. A good way to ensure that is to appoint an ambitious individual who presents substantial potential for career advancement within the organization. She will look at the challenge as a terrific career-building opportunity and will be highly motivated to succeed. The benefits will actually extend well beyond the projects time horizon. Indeed, the initiative will provide this high-potential employee with a broader understanding of the business, an extended network of relationships and stronger leadership skills. Appropriate knowledge of what we going to change I am absolute sure that the developer of the strategy do know what is needed to change to meet their target. But the question is the project manager is in a functional- level of the business, he is a subject matter expert in their respective area of responsibility. Are we sure he got a detail understanding of what is going on of the strategy. An expertise of the strategic goal will be needed to assist the functional level to achieve what they should achieve The necessary skills Change is complex subject; it will generate lots of pressure due to the instability and uncertainty. And also the manager has to handle manage conflicting priorities, multiple constituencies and fast-approaching deadline; Responsible for gilding the organisation through the numerous challenge of the transition. Therefore, the project leader must possess the proven ability to remain highly effective under intense fire. Otherwise, the  breakdown will occur when that person is overseeing a critical phase, so the whole project can be failed or delayed. Which is opposing what we trying to do. Step for implementation of Strategy within the Human Resource What is implementation? Implementation means causing changes to occur somewhere in your sphere of influence as a manager. It is impossible to implement any course of action and not have something change as a result. This means that certain things must be disrupted, discontinues, or deferred and new activities must begin. But most important, it means that after you have initiated action, things will be different. The key is in creating exactly the right amount of disruption. The following guide lines should help you to accomplish the implementation of your action plan with the minimum amount of adverse disruption and maximum of success: (Responsible Managers Get results- Gerald Faust 1998) Always implement changes from the top down. Always start with the best first. Set your own example. Remember that you cant motivate people to do something they dont know how to do. Recognize and reward desired performance early. Pace implementation so that the timing is consistent with the needs of your plan. Provide coaching and follow-up consulting, and, above all, be persistent Step 1: Planning the Change Process (These step are coming from article: How to implement organisation change) Like any complex project, change management requires detailed planning. Being responsible for guiding the process, the change facilitation team must see to it that detailed but realistic planning is undertaken in order to minimize divergence from the vision. Step 2: Goal translation The executive goals need to be translating to each level of the organisation in a meaningful, achievable target to each individual person within the organisation. For example: if the executive goal is increase the sales by 15 %, but how can salesman known how much is the percentage increase for a particular product. Therefore the goals must be SMART (Specific, Measurable, Additive, Reasonable and Time-bound). Furthermore the goal must is translate to a understandable language of different level of the organisation. Step 3: Barrier identification and Removal When the goals are clearly understood, we can start identifying the barriers that are preventing the achievement of these goals. The people who actually do the work should identify the barrier. Whenever possible, we must involve these people in implementation decision where these view may be crucial. For that reason, Manager must be able to communicate effectively at all levels and across each function. Resistance of Change Employees resist change because they have to learn something new. In many case there is not a disagreement with the benefits of the new process, but rather a fear of the unknown future and about their ability to adapt to it. de Jager (2001) argues, Most people are reluctant to leave the familiar behind. We are all suspicious about the unfamiliar; we are naturally concerned about how we will get from the old to the new, especially if it involves learning something new and risking failure de Jager (2001) Step 4: System for Managing Once the goals have been translated and barrier have been identify, the next critical step will be to develop a system for managing the organisation. Traditionally it will only be measured. But now it will be much larger. Not only a metrics need to designed, but meeting need to be developed, measure automation needs to be planned and specific accountability need to be determined. As far as the metrics are concerned, they need to report on goal achievement at each organisation level. And the reporting will also translated to its specificity. So if the executive goal is improved effectiveness of 25 % then that is what the metrics needs to report on at that organisation level. Similarly the metric in the finished goods packaging area may be boxed packed per hour and so on. Step 5: Rewards Recognition Rewarding and recognizing employees is essential to any business or organization. Employees like to know that the work they do is noticed and appreciated by their employers. It is important to recognize both the effort put into getting work and projects completed and the result. Recognition is one of the most effective ways to reinforce an organizations culture, support its objectives, and retain top performers. When we remember to take care of these very human needs for recognition and appreciation, we do a great deal to create an energized workplace we need in order to succeed in todays challenging times. Short Example of implementation SHRM to an organisation Age, skills and training ASDA will have a range of employees who have worked for different lengths of time and who have different levels of skills and training. The Human  Resource planner will seek to have a balance of new people entering ASDA in order to cover those who are leaving. The Human Resource Planner will also want to make sure that skill levels are raising within ASDA, and that training programmes are devised to make sure people have the skills to meet ASDAs jobs requirements. If all ASDAs skilled employees are just about to retire, ASDA will have to spend a lot of money on training to build up a new pool of expertise. Succession Succession is the way in which one person follows another person into a particular job or role within ASDA. ASDA need to make sure it is grooming people to take on the responsibility required. If ASDA do not do this, it will suddenly find itself with a vacuum where it has not developed the people to move into the appropriate position of responsibility, and ASDA will be missing the right people in key position to hold ASDA together. Conclusion: Strategic Human Resource Management (SHRM) is a broadness area. Meaning range from a human resource system that is tailored to the demands of the business strategy to the pattern of planned human resource activities intended to enable an organization to achieve its goals. Where in the first definition human resource management is a reactive management field in which human  resource management becomes a tool to implement strategy, in the latter definition it has a proactive function in which human resource activities actually create and shape the business strategy. As Strategy is equal to change, so, SHRM will be change as the changing environment. But one thing can be sure is- SHRM is a managing tool of Human factor which will assist the organization to achieve their goals, and it will controlling all the human factor, and getting the most from them, to optimize the efficiency and gain competitiveness of the organization.
